32BTree User AgreementUpdated: February 1, 2023
"32BTree User Agreement" (hereinafter referred to as "this agreement") is a legal agreement between you and 32BTree regarding the use of 32BTree's services. "32BTree" refers to 32Plus (Tianjin) Technology Co., Ltd., the operating company of 32BTree.
For the clauses in this agreement that have a material relationship with your rights and interests (including clauses exempting 32BTree's liability, clauses restricting your rights, dispute resolution clauses and jurisdiction clauses, etc.), 32BTree has used bold fonts to remind you, please pay attention to the key reading. Please ensure that you have carefully read, fully understood and accepted all terms of this agreement before using 32BTree services.
The term "users" in this agreement includes users who have registered for a 32BTree account (hereinafter referred to as "registered users") and users who have not registered with a 32BTree account (hereinafter referred to as "non-registered users"). Any user who has not registered 32BTree's products and/or services will automatically become a "non-registered user" of 32BTree when using 32BTree's services.
"32BTree Privacy Policy", "32BTree Community Convention", "32BTree Creation Convention" and other agreement specifications, statements, announcements, conventions, etc. published by 32BTree (hereinafter collectively referred to as "other 32BTree rules") are an integral part of this agreement. The same should be observed when using the 32BTree service. By accepting and agreeing to this agreement, you are deemed to have agreed and accepted other 32BTree rules.
1. Service description
1.1 32BTree provides you with services including but not limited to the following:
1.1.1 32BTree website: www.32btree.com (Including any other websites operated by 32BTree);
1.1.2 32BTree user Profile, Gold pens, Silver pens, My gold pens, My silver pens, Exchange;
1.1.3 Servers and network storage spaces directly owned or operated by 32BTree.
1.2 The services provided by 32BTree are limited to use on the platform described in 1.1.1 above (hereinafter referred to as the "32BTree Platform"). Any illegal means such as malicious cracking to separate the services provided by 32BTree from the 32BTree platform does not belong to the services provided by 32BTree as agreed in this agreement. The services provided by 32BTree.The perpetrator shall be responsible for all consequences arising therefrom, and 32BTree reserves the right to hold the perpetrator accountable in accordance with the law.
1.3 The only legal way to use 32BTree service is to register and log in officially. The 32BTree service (including but not limited to Account number, Gold pens, Silver pens, My gold pens, My silver pens, Exchange, etc.) obtained by users through any other means, any channel, or any method are illegal gains, and 32BTree does not recognize its validity, and once discovered, 32BTree has the right to immediately delete, clear, block, permanently block, etc., any adverse consequences caused by this are The user shall bear it.
1.4 32BTree reserves the right to make announcements to users in advance (including but not limited to pop-up announcements, website homepage announcements, and system messages) to modify, replace, and upgrade any software related to 32BTree services. If the user does not agree or does not accept the modification, substitution, or upgrade of 32BTree-related software, please stop using the 32BTree service directly, otherwise it will be deemed that the user agrees to and accepts the modification, substitution, or upgrade of 32BTree-related software, and the act of agreeing and accepting is still subject to this agreement.
2. Register
2.1 The 32BTree service is only provided to registered users. If you use the network storage space provided by 32BTree to upload and disseminate audio-visual programs, text, photography and other content, please register as a registered user in accordance with this agreement and other rules and processes prompted by the 32BTree rules.
2.2 You shall be fully responsible for all actions under the registered 32BTree account (hereinafter referred to as the "account"), and shall not infringe on the legitimate rights and interests of any entity, including but not limited to 32BTree.
2.3 You understand and agree that you only enjoy the right to use the account number and the virtual products and services provided by 32BTree under the account number. The ownership of the account number and such virtual products and services belongs to 32BTree.Without the written consent of 32BTree, you may not dispose of the right to use your account in any form (including but not limited to gifts, loans, transfers, sales, mortgages, inheritances, and licenses for others to use). If 32BTree finds or has reasonable reasons to believe that the user is not the initial registrant of the account, 32BTree has the right to suspend or terminate the provision of services to the registered account and cancel the account without notifying you.
2.4 You should keep your account information, account password, and other account-related information and materials properly. If account information, data and data are changed or lost or property is lost due to your behavior, you shall immediately notify 32BTree and bear the relevant legal consequences.
2.5 You agree and promise to do:
When your account or password is used without authorization, or any security issues occur, you will immediately and effectively notify 32BTree.
2.6 You agree and promise not to engage in the following behaviors:
2.6.1 register a 32BTree account with someone else's information;
2.6.2 register a 32BTree account in the name of another person without the legal authorization of another person;
2.6.3 stealing or misappropriating other people's 32BTree accounts, Gold pens, Silver pens, authentication marks, etc.;
2.6.4 use insulting, defamatory, pornographic, political, etc. words that violate laws, morals, and public order to register a 32BTree account;
2.6.5 maliciously exploit website vulnerabilities through legitimate or improper means for the purpose of illegally occupying 32BTree-related service resources;
2.6.6 other content that infringes the legitimate rights and interests of others and/or institutions.
2.7 You understand and agree that 32BTree has the right to block or permanently block users who violate the above terms.
2.8 You understand and agree that 32BTree has the right to withdraw the right to use the account as appropriate to the maximum extent permitted by law, without further notice to the user or obtaining the user's consent.
3. Content on 32BTree
3.1 The content on 32BTree refers to any information, data, text, music, audio, photos, graphics, videos, information, links or other materials uploaded, posted or transmitted or disseminated in any other way through the services provided by 32BTree, whether it is transmitted publicly or privately (hereinafter referred to as the "content"), the content provider and the uploader shall bear full responsibility for the content they provide or upload, and if it causes losses to 32BTree, they shall also be liable to 32BTree for compensation. For third parties who claim rights from 32BTree due to the content uploaded by the user, 32BTree has the right to directly take necessary measures such as deletion, blocking, and disconnection of links without prior notice to the content provider or uploader.
3.2 For the content you upload or post on 32BTree, you guarantee that you have legal copyright or corresponding authorization for it, and 32BTree has the right to display, distribute and promote the aforementioned content.
3.3 32BTree cannot know in advance and reasonably control the content uploaded through the 32BTree service. Therefore, you have predicted that when using 32BTree's services, you may be exposed to some content that makes you unhappy, uncomfortable or disgusted. You agree to waive any recourse against 32BTree arising therefrom.
3.4 Most of the content presented by 32BTree is medical professional content and cannot be used as a reference basis for the diagnosis, treatment, and disposal of diseases. Minors are prohibited from viewing it.
3.5 For more information, please refer to the "32BTree Creation Convention".
4. Usage rules
4.1 In the process of using the 32BTree service, users should comply with other laws, regulations, rules, regulations and other legally effective norms of your country or region.
4.2 Users are prohibited from engaging in the following behaviors:
4.2.1 Produce, upload, copy, transmit, and disseminate any content or other objectionable content that is prohibited by laws and administrative regulations or other objectionable content that opposes the basic principles established by the Constitution of the country or region where it is located, infringes the legitimate rights and interests of others, including but not limited to information, materials, text, software, music, photos, graphics, videos, information or other materials.
4.2.2 Endanger minors in any way.
4.2.3 Impersonate any person or institution, or falsely claim or make people mistakenly believe that it is related to any person or institution in a false and untrue manner.
4.2.4 Falsify the title or otherwise manipulate the identification information to make people mistakenly believe that the content is transmitted by 32BTree.
4.2.5 Upload, post, email or otherwise transmit advertising letters, promotional materials, "spam", etc.
4.2.6 Stalking or otherwise harassing others.
4.2.7 Upload, post, send e-mail or otherwise transmit information about software viruses or other computer code, files, and programs that interfere with, destroy, or restrict the functions of any computer software, hardware, or communication equipment.
4.2.8 Interfere with or destroy the 32BTree service or the servers and networks connected to the 32BTree service, or fail to comply with the provisions of this agreement.
4.2.9 Without the prior express written permission of 32BTree, in any way (including but not limited to robot software, spider software, crawler software and other automatic programs, scripts, software) and for any reason, self-or entrust others, assist others to obtain the services, content, and data of the platform.
4.2.10 Users must ensure that their uploaded content shall not violate the relevant regulations of the country or region in which they are located, and their uploaded programs shall comply with the laws, administrative regulations, and departmental regulations of the country or region in which they are located. At the same time, the uploaded content shall not contain the following content:
(1) objecting to the basic principles established by the Constitution of the country or region in which the country or region is located;
(2) endangering the unity, sovereignty and territorial integrity of the country or region where it is located;
(3) leaking secrets of the country or region where it is located, endangering national security, or harming national honor and interests;
(4) inciting ethnic hatred, ethnic discrimination, destroying ethnic unity, or infringing on ethnic customs and habits;
(5) promoting cult behavior recognized by the international community or the country or region in which it is located;
(6) disturbing social order and disrupting social stability;
(7) inducing minors to break the law and commit crimes and rendering violence, pornography, gambling, or terrorist activities;
(8) insulting or slandering others, infringing on citizens' personal privacy and other legitimate rights and interests of others;
(9) endangering social morality and harming the outstanding cultural traditions of the nation;
(10) other content prohibited by relevant laws, administrative regulations and regulations of the country or region in which it is located.
4.2.11 The content you produce, publish, and disseminate shall comply with the "32BTree Creation Convention" published by 32BTree, and shall not use new technologies and applications based on deep learning, virtual reality, etc. to produce, publish, or disseminate information content prohibited by laws and regulations such as false news and information.
4.2.12 If the uploaded content provided by the user contains information or content that violates the local policies, laws and regulations, the user shall directly bear all the adverse consequences caused by the above. If the adverse consequences are caused to 32BTree, the user shall be responsible for eliminating the impact and compensating for all losses caused as a result.
4.3 Users shall not issue any words carrying the "32BTree" brand through any channels or media (including but not limited to self-media, etc.) such as "Cooperation with 32BTree", "Co-produced with 32BTree", etc. Otherwise, the user shall be responsible for eliminating the impact and compensating for all losses caused thereby.
4.4 Rules for the use of gold pens and silver pens
4.4.1 If there are no special instructions, the specific usage methods and deadlines of virtual products such as gold pens, silver pens and/or redemption items obtained by users through the use of Login, Exchange, Send-Pen, Reward and other services are subject to the instructions attached to the 32BTree page or similar official documents of the nature of the above explanation shall prevail.
4.4.2 The pen system will be adjusted at any time due to user needs, website strategy adjustments, user acceptance and other factors. For specific information, please refer to the page description at the time.
4.4.3 The pen system is a free service provided by 32BTree to users. No invoice or other bill proof is provided for the use, consumption, exchange, etc. of the pen.
4.4.4 Based on the nature and characteristics of virtual goods, 32BTree does not provide return or exchange services for virtual goods redeemed with gold pens.
4.4.5 You understand and agree that you only enjoy the right to use the gold pen and silver pen. The ownership of the gold pen and silver pen belongs to 32BTree. Users are prohibited from disposing of the right to use the golden pen and silver pen in any form (including but not limited to gifts, loans, transfers, sales, mortgages, inheritance, and licensing others to use). Any user should obtain pen services through formal channels. All pens and their derivative services obtained through unofficial announcement channels shall not have legal effect on 32BTree. 32BTree has the right to unilaterally withdraw the relevant pens and terminate the corresponding services. In serious cases, 32BTree has the right to permanently block or cancel its users.
4.4.6 Unless there is no special agreement, the pens and their derivative products obtained by the user through formal channels will not be refunded in any cash, and can only be consumed in equivalent amounts through the pen service. If the user consumes all the pens he has obtained and no longer continues to use the pen service, the service will be terminated.
4.4.7 You agree and know that the exchange of silver pens for gold pens is irreversible.
4.4.8 For details about this part, please refer to the "32BTree Virtual Currency Usage Agreement" published by 32BTree.
5. Third-party links
The 32BTree service may provide links to other international Internet websites or resources. Unless otherwise stated, 32BTree cannot control the services of third-party websites, and 32BTree shall not be liable for any loss or damage caused by users using or relying on the above-mentioned websites or resources. We recommend that you carefully read 32BTree's terms of service and privacy policies before leaving 32BTree and visiting other websites or resources.
6. Intellectual property
6.1 All intellectual property rights in the 32BTree service and the software, technology, trademarks, materials, etc. used in the service belong to and enjoy 32BTree.
6.2 The intellectual property rights owned and enjoyed by 32BTree shall not be transferred due to any use by the user.
7. Disclaimer of Warranty
7.1 32BTree does not represent or guarantee the correctness or reliability of any content, information or advertisements contained in, through or connected to, downloaded or obtained from any network service; and 32BTree shall not be liable for any products, information or materials purchased or obtained by users through advertisements or displays on the service. Users use the service at their own risk.
7.2 Unless otherwise expressly stated in writing, all products and services provided to you by 32BTree are provided on an "as is" and "as available" basis.
7.3 32BTree does not guarantee the following matters, including but not limited to：
7.3.1 32BTree does not make any warranty related to the reliability, timeliness and performance of 32BTree's services.
7.3.2 32BTree does not guarantee that any products, services or other materials provided by it meet the expectations of users.
7.4 The user's use of any information downloaded or obtained through the 32BTree service is at the user's own risk. The user shall be fully responsible for any damage to the health or interests of the user or any other third party caused by the data.
7.5 32BTree shall not be liable for any direct, indirect, incidental, derivative or punitive damages for loss of profits, business reputation, information or other tangible or intangible losses caused by the following reasons:
7.5.1 all or part of the 32BTree service cannot be used;
7.5.2 any products, information or services purchased or obtained through the 32BTree service;
7.5.3 unauthorized use or modification of user information;
7.5.4 other matters related to the 32BTree service.
7.6 Users should keep their account numbers and passwords properly, strengthen password security, and beware of account leakage or theft. 32BTree shall not be liable for compensation for any losses caused by the leakage or theft of user accounts.
7.7 The user understands and agrees that he/she chooses to use the 32BTree service for free at his/her own risk, including but not limited to the user's behavior in the process of using the 32BTree service, as well as all consequences arising from the use of the 32BTree service. The user shall bear full responsibility for any damage to the computer system or loss of data caused by the use of the 32BTree service.
8. Service change, interruption, termination
8.1 You understand and agree that 32BTree may make changes to the content of the service based on the adjustment of its business strategy, and may also interrupt, suspend or terminate the service.
8.2 You understand and agree that in the event of a merger, division, acquisition, or asset transfer of 32BTree, 32BTree may transfer related assets under the service to a third party; 32BTree may also transfer some or all of the services and corresponding rights and obligations under this agreement to a third party for operation or performance after unilateral notification to you.
8.3 You understand and agree that if you violate laws and regulations, this agreement and other 32BTree rules, social ethics, public order and good customs, and/or infringe on the legitimate rights and interests of others when using 32BTree services, 32BTree has the right to unilaterally interrupt or terminate the provision of all or part of the services to you without notice.
8.4 After 32BTree terminates the provision of services to you, it has the right to delete your personal information or process it anonymously in accordance with the requirements of applicable law, and it also has the right to continue to store other content and information you keep on our platform in accordance with the time limit and method stipulated by the law.
9. Log out
9.1 The user has the right to apply for account cancellation to 32BTree. You can contact 32BTree customer service via email to cancel your account (except as otherwise provided by laws and regulations, this agreement or other 32BTree rules).
9.2 Special reminder: After you log out of your 32BTree account, you will no longer be able to log in and use all 32BTree products and services with this account, and 32BTree will also terminate the provision of our products and services to you under this account at the same time. Once the 32BTree account is logged out, it will not be restored. Please consider carefully before logging out.
9.3 If you are sure that you need to cancel your 32BTree account, you have fully understood and confirmed that the UID still exists after the account is cancelled, but you will no longer have the rights and interests related to the account, including but not limited to:
9.3.1 after your account is cancelled, you will no longer be able to log in and use all products and services under 32BTree with that account;
9.3.2 after your account is cancelled, all content, information, data, and records that you have logged in and used all products and services under 32BTree through that account will be anonymous. You can no longer search, access, obtain, use, and retrieve, including but not limited to: account information (avatar, nickname, personality signature, etc.), binding information, etc.;
9.3.3 after the account is cancelled, the account's Exchange, Send-Pen, Reward and other records will not be able to be viewed and retrieved;
9.3.4 after the account is cancelled, 32BTree has the right to no longer provide users with any account-related services;
9.3.5 you agree to waive the rights and interests and future expected benefits that the account has generated but not consumed during the use of 32BTree's products and services by way of account cancellation.
9.4 Before you apply to us to cancel your 32BTree account, in order to protect your account security and property rights, you need to check and ensure that the account you applied for cancellation meets the following conditions at the same time, including but not limited to:
9.4.1 the account number is the account number registered by the user through the official channel and complies with this agreement and related regulations; and it is your own member account number;
9.4.2 the account is in a secure state, including: it is not in the state of applying for a password or modifying the mobile phone number; there are no unprocessed (being) complaints or reports; other unsafe/abnormal states;
9.4.3 there are no unprocessed transactions in the account;
9.4.4 there is no sweepstakes initiated by you but not yet completed in your account;
9.4.5 there is no contractual relationship between the account number and all 32BTree's business or it is still in the contract period;
9.4.6 other conditions to be met.
9.5 If you have fully read and understood the contents of articles 9.2 and 9.3, and confirm that you have met all the conditions of Article 9.4, you can apply for account cancellation to 32BTree.The auditors will review the security status of your account and the use of your related products and services, and comprehensively determine whether your account meets the conditions. Those who meet the conditions will receive a re-approval confirmation from the auditors after 5-10 working days, and if the confirmation is correct, the account cancellation will be completed.
9.6 Once the 32BTree account is cancelled, the relevant user agreements and other rights and obligations documents that you have signed with us will be terminated accordingly (except for those that have been agreed to continue to take effect or otherwise provided by law).At the same time, you acknowledge and agree that even if your account is cancelled, it does not reduce or exempt you from the relevant responsibilities that you should (may) bear in accordance with relevant laws and regulations, relevant agreements, rules, etc. during the period of the agreement.
10. Privacy policy
32BTree pays attention to the protection of users' personal information and personal privacy. Personal information refers to various information recorded electronically or otherwise that can be used alone or in combination with other information to identify a specific natural person or reflect the activities of a specific natural person. When you browse, register, log in, and use 32BTree's products and/or services, 32BTree will process and protect your personal information in accordance with the provisions of the "32BTree Privacy Policy" published on the platform. Therefore, I hope you can carefully read and fully understand the full text of the "32BTree Privacy Policy", and when necessary, follow the guidelines of the "32BTree Privacy Policy" to make the choices you deem appropriate.
11. Minor clause
11.1 32BTree attaches great importance to the protection of minors. If you are a minor, you should give up using 32BTree's products and/or services.
11.2 Legal guardians should guide their children on the security issues that they should pay attention to when surfing the Internet, so as to prevent them before they happen. 32BTree is an exchange platform of a medical professional nature. On the platform, there will be discussions and publications on various diseases and traumas, drug use, medical device use, surgical methods, and treatment methods. This information may adversely affect minors, so 32BTree shall not be liable for any claims for losses caused by the negligence of the guardian and/or other forms.
11.3 32BTree reminds minors not to use the 32BTree service.
12. Application and jurisdiction of law
12.1 The entry into force, performance, interpretation and settlement of disputes of this agreement shall be governed by the laws of the People's Republic of China.
12.2 If there is any dispute over the content of this agreement or its implementation, it shall be resolved through friendly negotiation as much as possible; if the negotiation fails, all parties to the dispute unanimously agree to submit the dispute to the District Court of the People's Republic of China for settlement, you and 32BTree agree that the above-mentioned courts have personal jurisdiction.
12.3 For the avoidance of doubt, unless otherwise agreed in writing to the contrary, the validity of this legal application and governing clause shall apply to this agreement and other 32BTree rules, agreements, conventions, etc., including their amendments, supplements and updates.
13. Modification and notification of the agreement
13.1 32BTree has the right to modify this agreement in accordance with relevant laws and regulations, technical conditions, product functions and other changes and publish the revised agreement.
13.2 Once the foregoing content is officially released, 32BTree will remind you of the updated content in appropriate ways (including but not limited to pop-ups, emails, website announcements, etc.) so that you can keep abreast of the latest version of this agreement.
13.3 You are aware that the names of this agreement and the titles of each chapter are only for convenience and reading, and because this agreement is displayed on our platform in many places, it may take a period of time for the entire agreement to be renamed. During this period, the existence of the two names at the same time does not affect the meaning or interpretation of any of the terms in the text.
13.4 The revised content will form an integral part of this agreement, and you should also abide by it. If you have any objections to the revised agreement, please stop logging in and using 32BTree related services immediately. If you log in or continue to use 32BTree and related services, you are deemed to have fully read, understood and accepted the updated agreement and are willing to be bound by the updated agreement.
This agreement is effective from the date of publication.
